Brian Austin Green is finally responding to his estranged wife Megan Fox's request for divorce.

After over a month since the actress filed for legal separation, the Beverly Hills, 90210 alum has asked for spousal support and joint custody of their sons, according to court documents obtained by PEOPLE on Tuesday.

Green, 42, and Fox, 29, were married for five years and are parents to two children Noah Shannon, 3, and Bodhi Ransom, 18 months. He is also a father to 13-year-old son Kassius, from his previous relationship with ex Vanessa Marcil.

In her divorce filing, Fox listed the date of separation as June 15 [Green also lists this date in his filing]. Also in the papers, she cited irreconcilable differences and requested joint custody of the kids.

The pair got engaged in 2006, but called it off in 2009. They continued to spend time together despite publicly calling it quits, and eventually got engaged again in June 2010. They wed 24 days later.

Most recently, Green has been spotted still wearing his wedding band, in addition to expressing his emotions with T-shirt messages while running errands in Los Angeles.

Amid divorce drama, Fox continues to focus on her acting career. It was announced that she signed on for a starring role on Fox's New Girl during Zooey Deschanel's maternity leave.

Fox's first appearance is slated for the upcoming fifth season's sixth episode. The show is set to premiere in January.

The mom of two broke her social media silence on Sept. 18 with a black and white selfie on Instagram with the caption: "I'm still here."
