In a statement to PEOPLE, Campbell's lawyer, Guido Carlo Alleva from Alleva & Partners, said they would be appealing the ruling.
"We are appealing the ruling surrounding the 2009 incident. Due to the ongoing legal process, we cannot discuss the matter further at this time."
The Telegraph reports that the altercation happened while the photographer, Gaetano Di Giovanni, was taking photos of Campbell and her then-boyfriend Vladimir Doronin. Di Giovanni allegedly followed the couple, snapping photos of them sight-seeing, when Campbell swung her purse at him – leaving him with a scratched eye that required a three day recovery.
Although Campbell's attorney and the photographer reached an agreement outside of court and charges were withdrawn, Italian prosecutor Francesco Massara ordered the trial to proceed; Ansa, an Italian news agency reported.
