Socialite and reality tv personality Tinsley Randolph Mortimer's side of the story is coming out days after she was arrested for trespassing at sugar heir Nico Fanjul's home.

"Ms. Mortimer has been an invited guest at this home on countless occasions. During this particular visit, she thought it was best to leave the home," her attorney Matt Morgan tells PEOPLE in an exclusive statement. "Upon departing the residence, she discovered she had left her belongings in the home."

Morgan goes on to say that after leaving the residence, she discovered she'd let her belongings in the home of Fanjul, whom a source previously told PEOPLE she had dated on-again and off-again for three years.

"She attempted to enlist the support of law enforcement to help retrieve her personal items," the statement continues. "It was never her intent to cause any problem. This matter is highly personal and emotional for her. Ms. Mortimer hopes to resolve this misunderstanding. She will not be making any other statements at this at this time."

According to a police report obtained by PEOPLE, Mortimer was "crying and screaming irrationally" on Fanjul's property in Palm Beach, Florida when police found her. The police report also stated Fanjul claimed Mortimer was his ex-girlfriend and said he was inside the house with his new girlfriend but did not have Mortimer's belongings.

"They'd had a tumultuous relationship but they were seeing each other as recently as this past week," an insider previously told PEOPLE. "I've personally seen the 'I love you' and 'I miss you' text messages from Nico from just days ago."

Mortimer is best known for The CW's 2010 series High Society.
