'I AM DEEPLY EMBARRASSED'
She was the last celebrity you'd expect to turn up in a police blotter—and after her arrest April 19 in Atlanta for disorderly conduct, Reese Witherspoon is, says a source, "absolutely mortified." Her husband, talent agent Jim Toth, was arrested for driving under the influence of alcohol after an officer spotted him weaving at 12:40 a.m., according to a police report. Witherspoon, 37, a passenger, allegedly refused to stay in the car and berated the officer, even saying, "Do you know my name? ... You're about to find out who I am." Toth, 42, who had a blood alcohol level of .139, and Witherspoon, who a police source says was too "wobbly" to look into the camera for her mug shot, were briefly jailed; a court hearing is set for May 22. The actress released an apology: "I clearly had one drink too many, and I am deeply embarrassed about the things I said ... I have nothing but respect for the police." She then canceled interviews with Good Morning America and Late Night with Jimmy Fallon to promote her movie Mud.
Now the parents of 7-month-old son Tennessee are reflecting on what happened. "This is so out of character for Reese," says a source close to her. "I've never known her to get wasted." Meanwhile, an industry insider says Toth "is a big social drinker." A source in the couple's circle says the two have clashed over Toth's drinking, which makes Witherspoon "uncomfortable"—though others who know them dispute any tension and call the marriage "very solid." After the arrests, Witherspoon was concerned about her kids with ex Ryan Phillippe, Ava, 13, and Deacon, 9, who were with Phillippe in L.A. while she was filming The Good Lie in Atlanta. "She called the kids to tell them," the source says. "She's worried about how they'll be treated. She feels really bad about all of it."
