"Addiction is a terrible and vicious disease," attorney Blair Berk said in a statement.
Since leaving Promises rehab facility on July 13, Lohan has been wearing an electronic alcohol-monitoring bracelet on her ankle. She had it on even as she hit parties and nightclubs in Los Angeles and Las Vegas. However, police say the device did not play any role in notifying police that she was allegedly driving under the influence on Tuesday.
"Throughout this period, I have received timely and accurate reports from the testing companies," says Berk. "Unfortunately, late [Monday] I was informed that Lindsay had relapsed. The bracelet has now been removed. She is safe, out of custody and presently receiving medical care."
The actress, 21, was booked early Tuesday morning for DUI, possession of cocaine, transporting a narcotic into a custody facility and driving on a suspended license, according to Santa Monica police spokesman Lt. Alex Padilla.
Officers smelled alcohol on Lohan's breath when they first arrived on the scene Tuesday. She refused to submit to a preliminary blood alcohol test, so she was arrested and taken to the local police station, added Padilla.
Lohan's attorney posted the $25,000 bail required to have the actress released from jail at approximately 6:30 a.m. Her arraignment was set for Aug. 24.
Reached by PEOPLE, the star's father, Michael Lohan, said he's "heartbroken" by his daughter's arrest.
