Lindsay Lohan is not crying over an E-Trade ad she claims is defamatory. She's suing.

The starlet has already filed a $100 million suit against E-Trade for a commercial the company aired featuring its famous talking baby. In the spot, which debuted during the Super Bowl, there's a boyfriend-stealing baby named "Lindsay," who is also described as a "milkaholic," a reference Lohan says, to her hard-partying ways. According to the actress's lawyer, Stephanie Ovadia, the original ad featured a baby named "Deborah." Ovadia also says that when the baby's name changed, the adjectives used to describe her behavior did as well. Suspicious? Or just a coincidence?

E-Trade says the spot was meant to be "witty and memorable" – and is firing back against the lawsuit, denying that Lohan is the target of a parody. The company believes the claims are "without merit and we intend to defend ourselves vigorously," according to a statement released Thursday. What a jury decides – should the case go to trial – may be a long way off, so we ask you: Does Lohan have a case?
