Lindsay Lohan Goes Back to Rehab, Not Jail

She got a stern warning from the judge, but no more jail time – for now.

After failing a drug test last month, Lindsay Lohan was ordered back to rehab until at least Jan. 3 after she made a handwritten plea to the court for more treatment.

"You're staying there past New Year's. There's a reason for that," the judge said, drawing laughter in the courtroom.

The actress, 24, wearing a black blazer and skinny blue jeans and accompanied by her mother, Dina, appeared before L.A. Superior Court Judge Elden Fox on Friday to determine whether she'd get jail time or more treatment.



"You are an addict, I hope you understand that," Judge Elden Fox lectured Lohan in a calm but stern tone, adding he wouldn't allow her "to have a train wreck in my courtroom. You wouldn't be the first or last who will destroy a lucrative career."

"I agree that relapse is a part of recovery," he continued, "but I'm not going to be manipulated."



The judge said that if Lohan slips again after her release in January, he'd sentence her to six months in jail. Lohan, who sobbed before the judge, told him, "Thank you."

The prosecutor in the case, Danette Meyers, began the hearing by arguing for jail time. "The only way to catch her attention is jail," she said. "I don't think we've caught her attention yet."

But two reports submitted Friday by the Betty Ford Center and Lohan's handwritten letter about her earnest need for treatment swayed the judge. Lohan "doesn't need to be punished, she needs to be treated," her attorney Shawn Chapman Holley told the court.

Since Lohan will remain in rehab, the judge also ordered her Scram alcohol monitoring bracelet to be removed.

The actress is due back in court on Feb. 25, and will be subject to random drug and alcohol testing as well as sessions with her psychiatrist following her release.

Lohan has voluntarily spent the last three weeks at the Rancho Mirage, Calif. facility – at least her fifth time in rehab – after she bailed out of jail on Sept. 24.
