Jodie Foster's 89-year-old estranged father was sentenced Friday to five years in jail for taking $130,000 in down payments for homes that he never built.

Lucius Foster, a Sherman Oaks, Calif., building contractor, could have received as much as 25 years after being convicted of 21 counts of grand theft and nine counts of contracting without a license, all misdemeanors.

Los Angeles Superior Court Judge Gregory A. Dohi lamented that the trial didn't stop Foster from soliciting customers.

"Despite your personal charm, you are dangerous," Dohi said.

The prosecution alleged that nine additional people came forward in recent days, and that while the jury was deliberating, Foster emailed a potential victim that he was looking for lots.

A restitution hearing was set for Feb. 23.
