Bynes's attorney, Richard Hutton appeared on behalf of Odom on Friday at the Van Nuys, Calif., Superior Court. No plea was entered and an arraignment was postponed until Oct. 10.
Robert Shapiro, a longtime family friend of the Kardashians and O.J. Simpson's former all-star attorney, also reportedly represents Odom.
Khloé Kardashian's husband, 33, was arrested for DUI last month after being pulled over on the 101 Freeway in Los Angeles for doing 50 mph – too slow – after he was seen driving in a "serpentine manner," according to the CHP.
Odom then refused to take a chemical test at the jail, which under state law resulted in a one-year suspension of his driver's license.
Odom's drug and alcohol abuse has caused problems for the couple – whose four-year wedding anniversary was the same day as the DUI hearing – but Kardashian hasn't given up on the relationship.
A source close to the family recently told PEOPLE, "She still wants to save their marriage; she wants him to get better, but there is a lot to work out."
