A building contractor's $415,000 claim against Cher for work on her $5 million Malibu home has been reactivated by a California appeals court. In November of 1997, Arya Group Inc. accused the diva of breaking their agreement before she paid for the design and construction work that had been done. In 1998 the suit was dismissed for lack of a written contract between the parties. But on Thursday the 2nd District Court of Appeal decided that Arya might be able to enforce its alleged oral agreement. The court also said Cher is "a highly sophisticated homeowner with previous involvement in residential construction projects," rather than some ordinary individual for whom the consumer law was written.
