Attempts on Thursday to reach a plea-bargain between Robert Downey Jr.., 35, and California authorities who want the "Ally McBeal" actor to serve some sort of jail time for his drug arrest of last November have proved to be unsuccessful, according to news reports. The case now seems headed for a full-scale trial. "They have made an offer that does call for some sort of restraint on Mr. Downey's freedom," one of his attorneys, Daniel Brookman, told reporters. Brookman added that Downey is already in a drug-treatment program. California Superior Court Judge B.J. Bjork, who had twice postponed hearings in the case so that Downey's defense team could negotiate with prosecutors, ordered the actor (who did not attend Thursday's session) back to court on April 30 for a preliminary hearing in the case. Bjork will then decide whether or not enough evidence exists to make Downey stand trial on charges of drug possession. Palm Springs police busted the actor in his resort hotel room on Nov. 25.
