Pamela Anderson will not be called to testify in the wrongful death and negligence trial against her ex-husband Tommy Lee, Los Angeles Superior Court Judge Richard Neidorf ruled Tuesday.

The former Motley Crue drummer, 40, is being sued following the drowning death of a 4-year-old boy who was attending a birthday party for Lee and Anderson's son, Brandon, in June of 2001.

Anderson was not at Lee's Malibu mansion on that fateful day, and the jurist in the case said Tuesday that an appearance by Anderson would be too "prejudicial," the New York Post reports.

Attorneys for the parents of the drowning victim, Daniel Karven-Veres, wanted to call the former "Baywatch" star to the stand in order to establish that Lee has previously shown little regard for child safety.

Five years ago, Lee was convicted of assaulting Anderson while she was pregnant.

After Neisdorf's decision, the plaintiffs' lawyer, Thomas Girardi, said in the courtroom: "We don't think he should get a hall pass behaving the way he did."

In other testimony Tuesday, Lee's lawyers reportedly tried to infer that Judith Ziehm, a nanny in whose care little Daniel had been placed at the party, was responsible for the tragedy. (Daniel's own nanny had left the boy at the party and then took off for a concert, it was stated in courtroom testimony last week.)

Ziehm said only that she had agreed to drive Daniel home.
