Courtney Love surrendered to Beverly Hills police on Tuesday and was charged with felony possession of the prescription painkillers hydrocodone and oxycodone after she was arrested trying to break into a house earlier this month, reports the Associated Press.

District attorney's spokeswoman Sandi Gibbons says the former Hole singer and widow of Kurt Cobain -- who also lost custody of her 11-year-old daughter Frances Bean Cobain following her arrest -- surrendered voluntarily and that bail was recommended at $20,000.

The court will consider whether Love is eligible for a drug diversion program, Gibbons adds. Such a program would spare her jail time, notes Reuters.

Both the painkillers Love allegedly had in her possession can be prescribed legally. "If she had prescriptions, we would not be charging illegal possession," Gibbons tells AP.

A spokeswoman for Love could not immediately be reached for comment.

Los Angeles Police took Love into custody on Oct. 3 after she was caught breaking windows while standing outside former boyfriend-manager Jim Barber's home in the middle of the night.

Hours later, after she was freed on $2,500 bail, she was found by police in Beverly Hills in a condition that warranted her being rushed to Century City Hospital for treatment of an unexplained "medical emergency."

Last week, before her court appearance in her custody battle to get back daughter Frances, Love told PEOPLE: "I'm not on some downward spiral. This is stupid. I'm not on narcotics. I'm fine. I just want my daughter back."

Love's claim to be "fine" proved a no-go in court, however. After an hour-long hearing, the judge decided to leave Frances in the temporary custody of Kurt Cobain's mother, Wendy O'Connor.
