Prosecutors Say Courtney Used Cocaine

Courtney Love tested positive for cocaine when she was arrested last October and is now negotiating a deal to resolve drug charges in that Los Angeles arrest, prosecutors say.

Under a deal presented to the 39-year-old former Hole singer, charges against Love will be dropped if she completes a drug-treatment program, said Jerry Baik, an assistant supervising attorney with the Los Angeles City Attorney's Office, according to wire reports.

"It's a great idea for her because she can probably benefit from the program, and if she completes the program she won't have a conviction in the case," Baik told reporters outside the courtroom after Monday's hearing.

He added: "But if she fails to complete ... this program then she will be required to do 90 days in jail."

Love did not appear at Monday's hearing, which was one of two cases stemming from the Oct. 2 incidents. She faces misdemeanor charges of being under the influence of a controlled substance and disorderly conduct after being arrested for allegedly trying to break into the L.A. home of ex-boyfriend James Barber.

Love's attorney, Michael Rosenstein, recently told Reuters that he was negotiating a plea deal and awaiting the results of Love's drug tests.

The city, however, has received the results, Baik said, adding: "One of the drugs that's important to us has been cocaine, and that came out positive." He declined to identify the other drugs, the Associated Press reports.

Baik said the city is prepared to prove its case should the plea deal fall through. Los Angeles Superior Court Judge Patricia Schnegg ordered the parties back on May 25 to cement the deal or start trial.
