Lawyers for Martha Stewart's stockbroker broker Peter Bacanovic, who was convicted along with the domestic diva of lying to federal investigators, complained on Thursday that the government has failed to turn over evidence that could be used in seeking a new trial for the disgraced duo, reports Reuters.
Stewart, 62, and Bacanovic, 41, requested earlier this month that their March 5 convictions be tossed out after ink expert Larry Stewart (no relation to Martha), who served as a government witness against them, was charged with lying during his testimony at their conspiracy trial.
Larry Stewart has pleaded not guilty to the perjury charges against him.
Bacanovic's lawyers said on Thursday that to date they have only received transcripts of Larry Stewart's testimony, a copy of his resume and various other documents. What they seek is additional information about discussions between prosecutors and the witness during the trial.
Martha Stewart is due to be sentenced on July 8 – unless she is granted a new trial based on perjury charges against the lab director.
