Tracey Gold Faces 3 Felony DUI Counts

Former Growing Pains star Tracey Gold is facing three felony counts from prosecutors following her DUI arrest earlier this month, in which she rolled her SUV while allegedly driving drunk on a California highway with her husband and kids in the vehicle.

The counts are driving under the influence of alcohol causing bodily injury, driving with a blood-alcohol level in excess of 0.08 percent causing injury, and felony child endangerment, Senior Deputy District Attorney Kim Gibbons tells the Associated Press.

Gold was arrested Sept. 3 by California Highway Patrol officers after she lost control of her 2001 GMC Yukon with her husband and three sons inside. Gold's husband, Roby Marshall, and two of their sons (ages 5 and 4 months) were not seriously injured but their eldest child, 7-year-old Sage, suffered a broken clavicle and a head laceration.

After CHP officers administered sobriety tests, Gold was arrested and booked under her married name, Tracey Gold Marshall. She spent five hours behind bars before being released on $50,000 bail, said CHP spokesman Steve Reid.

The maximum sentence in such cases is five years in prison, says Gibbons, adding that it is also common for people in such cases to receive probation or a lesser amount of jail time.

Gold's lawyer, Blair Berk, said his client plans to plead not guilty at her Oct. 19 arraignment.

"Tracey is a wonderful mother and incredibly respected in her community. Hopefully the truth of what really occurred will be more important to people than speculation or headlines," Berk said.
