A video showing Grey's Anatomy star Eric Dane, his wife Rebecca Gayheart and another women in apparently compromising positions is ancient history and had better not be used for commercial purposes, says an attorney for the married couple.

In a statement released Monday evening, the actor's lawyer, Marty Singer, said of the tape being widely discussed and shown over the Internet: "This is simply a private, consensual moment involving a married couple, shot several years ago, which was never intended to be seen by the public."

Eric Dane's Grey's Anatomy character is nicknamed McSteamy. Now it appears the actor's real life may live up to that moniker: A video – which appears to feature the actor, his wife, Rebecca Gayheart, and another woman in some compromising positions – has spread like wildfire online.

Fans of the star aren't holding back. "How hilarious is the Eric Dane 3 way sex tape? I'm convinced everyone has a sex tape. There's a lot of anatomy present and it isn't grey, " writes Travonfree on Twitter.com.

Most posters on Twitter seem amused – or excited – by the newly surfaced tape, which was first posted on Gawker.com.

In addition to his role as Dr. McSteamy on Grey's Anatomy, Eric Dane has another job these days: starting a family.

During an appearance on The Ellen DeGeneres Show set to air Wednesday, the actor, 36, admitted he and his wife of four years, actress Rebecca Gayheart, also 36, would like to have children.

"We’re currently working on that," he said. But he added the process hasn't been simple.

"It’s funny because you get the doctors involved and they call you and it's like, In eight days I’ll have to put in some work," he explained. Then, he said, for four days, "I will be very busy and I probably shouldn’t schedule anything else."

Eric Dane – "McSteamy" to Grey's Anatomy fans – will have a busy fall.

Not only will the actor's hit series return for a fifth season on Sept. 25, but he's also proud papa to a new Chihuahua.

"We just adopted a little dog," Dane told PEOPLE at Friday's Sixth Annual Tom Arnold Roast, to benefit the Exceptional Children's Foundation. His wife, actress Rebecca Gayheart, was his date at the event.

The dog's name is Nellie, "like 'Whoa, Nellie,'" Dane, 35, explained. "We adopted it on the street from this adoption agency. She was thrown out of a car, so we took her."

"She's a rescue," Gayheart added.

Dane and Gayheart, 37, will celebrate their four-year wedding anniversary on Oct. 29, but don't have anything elaborate planned and will just go with the flow.

"As long as we're together, it's fine," Gayheart said. "The two of us, dinner."

As Owen Wilson and Eric Dane continue filming Marley & Me at the South Florida Sun-Sentinel, the newspaper's staff is offering their own insider's view of being so close to the spotlight of Hollywood.

Columnist Ralph De La Cruz, who is working as an extra on the film – which is based on the best-selling book by former Sun-Sentinel columnist John Grogan – has found the experience less than glamorous.

"Once you're on set, you can't leave. Because you could be called at any moment," he wrote Thursday. "It's like being on jury duty. Except the people are friendlier. The pay is slightly better ($100). And food and drinks are free."
