One of the most infamous moments in Super Bowl history may have seen Janet Jackson bear a lot of flesh – but that doesn't mean CBS ought to bear a big financial burden, a three-judge panel has ruled.

A federal appeals court in Philadelphia on Monday tossed out the $550,000 that the Federal Communications Commission levied against CBS Corp. for the 2004 nationally televised halftime show that introduced the phrase "wardrobe malfunction" to the world. The court said the FCC had acted "arbitrarily and capriciously."

Some 90 million Americans were watching when Justin Timberlake ripped off part of Jackon's bustier as he sang, "Gonna have you naked by the end of this song."

Janet Jackson might feel "allergic to marriage," but the pop star is ready to have a baby, says longtime boyfriend Jermaine Dupri.

"Yeah, soon," Dupri told PEOPLE Sunday at a dinner party hosted by New Era and Belvedere Vodka at West Hollywood's STK restaurant. "Right after the tour." (Jackson, 42, recently announced she'll be on the road this fall.)

Though Janet Jackson says she's "so excited to be able to hit the stage again" on her upcoming North American tour, she's less than thrilled about her struggles with her label, Island Records.

"I'm trying to figure out a way to say this, but just to say it and to be quite honest, they just stopped all promotion whatsoever on the album so I don't think you're going to hear another single off this album," Jackson told the hip-hop Web site SOHH.com. Island released Jackson's latest album, Discipline, in February.

"It was definitely in my heart to go to Europe and to support this album," she said. But "it's about teamwork, it's not something I can totally do on my own. Unfortunately, things have turned out the way that they have with the differences between the label and myself."

It's not everyday that Janet Jackson drops by to make someone's dream come true. But on The View Tuesday, the pop star did just that. Specifically, Jackson gave co-host Sherri Shepherd a pair of tickets for her fall concert – so that Shepherd wouldn't have to sleep in the street to get some. When Jackson – clad in white –dropped by, a visibly ecstatic Shepherd jumped from her seat to embrace her pop idol. "I'm such a fan of yours," she enthused while the crowd cheered. "I have every album; I have every poster; I have all of your program books. Aside from Michael, you are my second favorite, girl."

Janet Jackson's boyfriend Jermaine Dupri – who announced Thursday that he's heading up brand-new record label, TAG Records – tells PEOPLE that Jackson has fully recovered from the illness that forced her to cancel an appearance on Saturday Night Live last month.

"She's 100-percent better now," says Dupri. "She was really sick. She had bronchitis." But the singer is back on track: "She's in Japan right now. She's better and doing all the promotion that she didn't get to do because she was sick when the album launched."

Janet Jackson may be waylaid while recovering from the flu, but the show will go on – with Mariah Carrey.

Carey, 37, will replace Jackson on Saturday Night Live this weekend after Jackson, 41, fell ill Monday night. "They wanted her for 10 years," says a rep for Carey. "It's going to be hot!"

The Grammy-winning songbird will join host Jonah Hill for her first appearance on the show in more than a decade. Carey will perform tracks from her upcoming album E=MC2, which will be released April 15.

Janet Jackson is taking it easy following her bout with the flu. The pop star, 41, who paid a visit to Cedars-Sinai Medical Center in L.A. Monday night after falling ill, has decided to cancel an upcoming Saturday Night Live appearance originally scheduled for Saturday, her rep confirms to PEOPLE.

"The main prescription to get over this flu is rest – and that's what she has to do," her rep says. No replacement has been announced yet.
