Kelly Rutherford Vows to 'Never Stop Fighting for My Children'

Locked in an international custody battle since she and Europe-based ex-husband Daniel Giersch divorced in 2009, Kelly Rutherford refuses to give up the fight – even after a judge on Tuesday ruled that the Gossip Girl actress's schedule is flexible enough to allow her to travel back and forth to Monaco to visit her two children.
"I will never stop fighting for my children. They're my babies and they're very young and this is going to affect them profoundly and I want to be there as much as I can to show them that this isn't my fault, this isn't something I wanted, and that's my concerns," Rutherford, 43, said on Saturday's edition of ABC's Good Morning America.
In court on Friday, Rutherford's request for her kids – Hermes, 5, and Helena, 3 – to be brought back to her in New York while she appealed Tuesday's legal decision was denied.

Since their 2009 divorce, Kelly Rutherford and her ex-husband, Daniel Giersch, have been involved in a heated custody battle ... and three years later, it's as nasty as ever.
The bitter dispute spans the globe as Giersch, who lives in Monaco, is barred from returning to the U.S. because of a revoked visa. The Gossip Girl actress, 43, has been fighting for sole custody of Hermes, 5, and Helena, 3, so she may keep them in the country.
On Tuesday, a judge ruled that Rutherford's schedule is flexible enough to allow her to travel back and forth to Monaco to visit her children.
"Kelly is devastated by the court ruling and will never stop fighting for her children," her spokesperson tells PEOPLE. "An appeal is already in the process."
"To protect the children and also Kelly, I have decided to continue not to comment," Giersch tells PEOPLE. His lawyer, Fahi Takesh Hallin, meanwhile says Giersch is "focused on co-parenting the children, and continuing to promote any and all contact of the children with Kelly."

It seems Kelly Rutherford's kids don't need a bodyguard – or a nanny. Their dog, Oliver, thinks he's both.
"He's very bossy," the Gossip Girl star told PEOPLE at a Kiehl's store opening in New York on Tuesday. "He really shows boundaries with the kids."

With Ryan Gosling and Blake Lively apparently enjoying a special closeness, Kelly Rutherford – who plays Lively's mother on Gossip Girl – has given the pair the thumbs-up.
"It'd be great [if they were dating]. Blake's an amazing person," Rutherford said Friday at the opening of the new restaurant Beauty & Essex in New York. "She's so gorgeous. He's a lucky man if they are!"

When Matthew Settle confirmed his separation from his wife, his Gossip Girl costar Kelly Rutherford could empathize, thanks to being in the middle of a divorce herself.
"He's going through his own thing, I'm going through my own thing – we kind of just support each other," she told reporters at this week's Manhattan premiere of the Discovery Channel's new nature film, Life.
And the biggest form of support? Bonding over their kids. "We both have small children that we really love, so we both just talk about them the whole time," says Rutherford, who is mom to Hermes, 3, and Helena, 8 months. "Matthew was saying his daughter, [Aven Angelica, 1], just took her first steps the other day, and he was kind of teary-eyed, it was just beautiful."

She may be going through a nasty divorce but Kelly Rutherford is still seeing the silver lining.
After obtaining a restraining order against her estranged husband, Daniel
Giersch, earlier this week, the Gossip Girl actress put on a brave face Saturday to attend the DSW Presents: Step Up & Step Out brunch in Manhattan.
"I have it very lucky even though in my personal life right now I’m going through a very challenging time," Rutherford said. "I do know that there are women that I can help somehow because they’re going through a much tougher time."

Gossip Girl star Kelly Rutherford obtained a temporary restraining order Thursday against her estranged husband Daniel Giersch, according to Los Angeles Superior Court records.
Rutherford alleges the German businessman "has begun to follow me, my mother and my nanny and he shows up unexpectedly to threaten and scare us," says the order, which is in effect for 21 days pending a court date to hear evidence.
Giersch's lawyer Fahi Takesh Hallin denied the claims, calling them "fabricated accusations" intended to harm Giersch's reputation.

The legal guns in their seven-month custody battle have silenced – for now.
Gossip Girl star Kelly Rutherford and her estranged husband, German businessman Daniel Giersch, have reached a temporary settlement of joint legal and physical custody over Hermes, 2, and Helena, 2 months, court papers filed in Santa Monica, Calif. show.
The agreement, in effect until April 2010, is built around Rutherford's filming demands in New York, where both parents will temporarily live. Rutherford, 40, and Giersch, 36, were also ordered into co-parenting counseling.

Just one month after giving
birth to her second child – daughter Helena – Kelly Rutherford was relaxing poolside ... with her kids close by, of course! The Gossip Girl star took son Hermes, 2 ½, and her newborn to the Sierra Mist Beach House in Malibu, Calif., on Saturday, where the trio spent the afternoon at a barbeque there.
"Kelly was an adorable mother, having a nap poolside with both kids on her," an onlooker says. "Helena was so cute and didn't even cry." Meanwhile, according to the onlooker, Hermes loved the backyard and playing by the pool. Says the onlooker: "He didn't want to leave." – Jennifer Garcia

The ill will from a divorce and custody battle between Kelly Rutherford and her husband has now apparently reached into the hospital delivery room.
The Gossip Girl star welcomed her second child, daughter Helena, on Monday, but the actress's estranged husband, German entrepreneur Daniel Giersch, tells PEOPLE he was never notified of the birth, and instead read about it in online reports, some unfavorable toward him.
"Media reports claiming that I neglected to attend my daughter's birth are total lies and fabrication," Giersch says in a statement. "I was never informed by Kelly about the birth of our daughter, nor was I invited to attend. In fact, I found out about it through Internet reports like everyone else. Although this sickens me, I am of course overjoyed that our baby was born healthy. I would've wanted nothing more than to hold our newborn daughter for a few moments, and I only seek to coparent both our children responsibly and with love."
