Kelly Rutherford: 'I'm Going Through a Challenging Time'

She may be going through a nasty divorce but Kelly Rutherford is still seeing the silver lining.
After obtaining a restraining order against her estranged husband, Daniel
Giersch, earlier this week, the Gossip Girl actress put on a brave face Saturday to attend the DSW Presents: Step Up & Step Out brunch in Manhattan.
"I have it very lucky even though in my personal life right now I’m going through a very challenging time," Rutherford said. "I do know that there are women that I can help somehow because they’re going through a much tougher time."

Kelly Rutherford Gets Restraining Order Against Husband

Gossip Girl star Kelly Rutherford obtained a temporary restraining order Thursday against her estranged husband Daniel Giersch, according to Los Angeles Superior Court records.
Rutherford alleges the German businessman "has begun to follow me, my mother and my nanny and he shows up unexpectedly to threaten and scare us," says the order, which is in effect for 21 days pending a court date to hear evidence.
Giersch's lawyer Fahi Takesh Hallin denied the claims, calling them "fabricated accusations" intended to harm Giersch's reputation.

The legal guns in their seven-month custody battle have silenced – for now.
Gossip Girl star Kelly Rutherford and her estranged husband, German businessman Daniel Giersch, have reached a temporary settlement of joint legal and physical custody over Hermes, 2, and Helena, 2 months, court papers filed in Santa Monica, Calif. show.
The agreement, in effect until April 2010, is built around Rutherford's filming demands in New York, where both parents will temporarily live. Rutherford, 40, and Giersch, 36, were also ordered into co-parenting counseling.

Just one month after giving
birth to her second child – daughter Helena – Kelly Rutherford was relaxing poolside ... with her kids close by, of course! The Gossip Girl star took son Hermes, 2 ½, and her newborn to the Sierra Mist Beach House in Malibu, Calif., on Saturday, where the trio spent the afternoon at a barbeque there.
"Kelly was an adorable mother, having a nap poolside with both kids on her," an onlooker says. "Helena was so cute and didn't even cry." Meanwhile, according to the onlooker, Hermes loved the backyard and playing by the pool. Says the onlooker: "He didn't want to leave." – Jennifer Garcia

Kelly Rutherford's Husband: I Wasn't Notified of Daughter's Birth

The ill will from a divorce and custody battle between Kelly Rutherford and her husband has now apparently reached into the hospital delivery room.
The Gossip Girl star welcomed her second child, daughter Helena, on Monday, but the actress's estranged husband, German entrepreneur Daniel Giersch, tells PEOPLE he was never notified of the birth, and instead read about it in online reports, some unfavorable toward him.
"Media reports claiming that I neglected to attend my daughter's birth are total lies and fabrication," Giersch says in a statement. "I was never informed by Kelly about the birth of our daughter, nor was I invited to attend. In fact, I found out about it through Internet reports like everyone else. Although this sickens me, I am of course overjoyed that our baby was born healthy. I would've wanted nothing more than to hold our newborn daughter for a few moments, and I only seek to coparent both our children responsibly and with love."

Kelly Rutherford Craves Kale and Chard

Forget 7-11. When Gossip Girl star Kelly Rutherford has cravings, she has to race to the farmer's market.
"I crave a lot of greens when I'm pregnant," says Rutherford, 40, who's due to welcome her second child, a daughter, within days. "I love kale and chard, so I'll steam that and then I'll make an organic turkey burger."
The actress says her second pregnancy feels more relaxed. "I'm making it a point to rest more," says Rutherford, who together with son Hermés, 2 1/2, attended the 3rd Annual Kidstock Music and Arts Festival presented by UGG benefiting One Voice and the Scholars Program in Beverly Hills, Calif., on Sunday.
She has also taken a "sustainable" approach to prepping for her daughter's arrival, re-using many of her son's baby furniture – including a white
Target changing table – and baby clothes. "I've been trying to be smart about it," she says.

Kelly Rutherford Hires Private Eye to Videotape Husband

Although they both stated in January they'd try to co-parent amicably, Gossip Girl star Kelly Rutherford and estranged husband Daniel Giersch are facing off in court again in a dispute over their 2-year-old son.
Rutherford, 40, who claims son Hermes is in danger because Giersch, 34, leaves the swimming pool uncovered at his Los Angeles home, hired a private eye last week to conduct three days of video surveillance on the German businessman, court documents show.
"Hermes is very young, very active, not water safe and in a moment's notice, could fall into the swimming pool," Rutherford warns.

Pregnant Kelly Rutherford Puts Parenting First

She may be going through a nasty divorce with estranged husband Daniel Giersch, but pregnant Gossip Girl star Kelly Rutherford is staying positive and focusing on being parent.
"I'm doing great," the actress told PEOPLE Tuesday at the Lyn Devon trunk show at ARCADE by Rochelle Gores.
Asked about how she remains upbeat despite the struggles in her personal life, she says, "I'm doing so well because I know I'm making the right decision. I love my son so much and he's loved by both us – his father and I – greatly. My greatest joy in life right now is being a mom."
In January, a Los Angeles court sided with Rutherford, allowing the star to take son, Hermes, 2, to New York, where her show is filmed, until the end of March. Giersch had strongly objected, saying his home in L.A. would offer a more stable environment. Still, Giersch said that he and Kelly would work together to create a stable life for their son.

Despite intense mudslinging and low blows on both sides of their three-week custody dispute, Kelly Rutherford and her estranged husband Daniel Giersch hope to stay on good terms.
"I hope so, yes, I really do," Rutherford, 40, told reporters Friday when asked if she would remain cordial with the German entrepreneur. "We're both going to be with our son. I'm relieved we're going to have a [custody] schedule in place."
A Los Angeles court ruled Friday that the pregnant Gossip Girl star would be allowed to take their son, Hermes, 2, to New York, where the show is filmed, until the end of March. Giersch had strongly objected, saying his home in L.A. would offer a more stable environment.

Judge Sides with Kelly Rutherford in Custody Issue

Kelly Rutherford will be allowed to take her son Hermes, 2, to New York until the end of March, a judge in Los Angeles ruled Friday.
Judge Michael Levanas stated that to leave Hermes in L.A. with Rutherford's estranged husband, Daniel Giersch, would be removing the child from his mother "cold turkey," which could be detrimental to the boy.
In making his ruling, the judge stated that he had to consider "the plan least likely to cause trauma to [Hermes]." If Rutherford went to New York without her son, "the minor would have his first multiple nights away [from his mom]," said Judge Levanas.
