Kelly Rutherford has told PEOPLE she'll never stop fighting for her children, and now, her attorney is explaining their next step in the Gossip Girl star's crusade to move them back to America.

Three years have passed since a judge ordered Kelly Rutherford's children to move to Monaco with their father, German businessman Daniel Giersch, but Hermes, 8, and Helena, 6, are still adjusting to life outside the United States.
"They're beautiful children," a former teacher at their exclusive school tells PEOPLE. "They look like Gap kids, but they blend in here, too. They're both reserved."
When it comes to their education, no expense is spared: "It's a very exclusive," adds a 41-year-old mother whose children attended the same school. "Kids come from all over the world and it follows a British curriculum. Some kids speak as many as five languages so school can be challenging for them. It's good academically but very elite."

On Aug. 6 Kelly Rutherford was supposed to put her children Hermes, 8, and Helena, 6, on a plane back to Monaco where they've been living with their father Daniel Giersch, for the last three years. Instead, the actress made a controversial decision and refused to return her kids.
"They were totally great the entire time. We were painting, horseback riding," Rutherford tells PEOPLE. "Then right when they knew they were going to go back, they got really panicky. My daughter was crying, my son started saying, 'Mommy, I'm afraid.' "
So Rutherford had to act quickly.

A federal judge has rejected Kelly Rutherford's last-minute attempt to get her children back after a state court ordered last week that they return to their father in Monaco.
Court records show that Rutherford, 46, filed an emergency writ in federal court Aug. 11 in an attempt to get her son Hermes, 8, and daughter Helena, 6, back – just a few hours after a New York Supreme Court judge sent them to live with her ex-husband Daniel Giersch in Monaco.
The judge denied Rutherford's petition and tossed the suit that same day on the grounds that the case was a state matter, court records show.

"I walked into a courtroom where everything felt like it was already done. It was a done deal," Rutherford told Good Morning America's Robin Roberts on Friday morning. "His mother was sitting there with plane tickets, smiling, ready to take them."
Son Hermes, 8, and daughter Helena, 6, left for the airport with their paternal grandmother Tuesday straight from the courtroom. Initially, Rutherford did not fully comply with the judge's order by arriving at the hearing alone, saying she wanted to protect the children from media exposure.

A Connecticut woman says she rescued Kelly Rutherford's daughter from nearly drowning in a hotel swimming pool in Bermuda in 2012 while the child was in the care of her father, Rutherford's ex-husband Daniel Giersch.
"I observed Helena fall into the hotel pool and nearly drown," Layla Lisiewski, a former Merrill Lynch trader turned artist, says in an affidavit exclusively obtained by PEOPLE. The court document was filed in 2012 as part of Rutherford's custody battle with Daniel Giersch.
Lisiewski says in the affidavit that Giersch only realized what was happening after she had jumped in the pool and pulled the little girl out.
"As soon as the man [Giersch] saw me holding his daughter, who was still whimpering, he jumped over and ran to us," the affidavit says of the German businessman. "He appeared terrified and took Helena from my arms."
