Kelly Rutherford will be allowed to take her son Hermes, 2, to New York until the end of March, a judge in Los Angeles ruled Friday.
Judge Michael Levanas stated that to leave Hermes in L.A. with Rutherford's estranged husband, Daniel Giersch, would be removing the child from his mother "cold turkey," which could be detrimental to the boy.
In making his ruling, the judge stated that he had to consider "the plan least likely to cause trauma to [Hermes]." If Rutherford went to New York without her son, "the minor would have his first multiple nights away [from his mom]," said Judge Levanas.

Kelly Rutherford and her estranged husband Daniel Giersch sparred over the actress's work demands as they both testified Thursday in a bitter custody dispute over 2-year-old son, Hermes.
The pregnant Gossip Girl star, 40, who has filed for divorce from Giersch, 34, is seeking to take Hermes to New York, where the show is filmed, until the end of March. Giersch strongly objects, calling her job detrimental to their son.
After almost two hours of testimony, no ruling was made and the hearing will resume Friday morning.
Giersh, a German entrepreneur, testified that Rutherford's "being on call in New York, working 20-hour days, her being told to go here, go there, jump into this car, go to this event," contributed to their failed marriage.

Kelly Rutherford and her estranged husband Daniel Giersch have been ordered to testify in court regarding travel issues surrounding their 2-year-old son, Hermes.
Both parties appeared Wednesday for a 20-minute hearing in a Santa Monica, Calif., court, and both will return Thursday to take the stand.
The Gossip Girl star, who's four months pregnant with their daughter, is seeking to take Hermes to New York (where the show is filmed) for the next several months. Giersch, who has called his wife's work schedule "very hectic and stressful," strongly objects to having her take Hermes to New York.

Kelly Rutherford says she twice called the police on estranged husband Daniel Giersch recently, adding the German entrepreneur frightened her and yelled at her within inches of her face, court documents reveal.
The couple have been mired in an increasingly nasty divorce and are battling over the welfare of their son, Hermes, 2. Rutherford, 40, is four months pregnant with their second child, a daughter.
The first time Rutherford called police occurred when the couple were staying at the Wales Hotel in New York "because [he] kept yelling at me in front of Hermes, and threatening that he was going to take Hermes," she said in the Jan. 16 court filing. "[He] kept saying that I was 'going to learn,' and that he was 'going to teach [me] a lesson.'"

Kelly Rutherford's estranged husband says that the actress's often 20-hour workdays filming Gossip Girl take a toll on their 2-year-old son, Hermes, according to court documents obtained by PEOPLE.
"The filming lifestyle in New York is very hectic and stressful from what I have personally witnessed," Daniel Giersch said in a Jan. 9 court filing.
According to his papers, "Often times the TV show calls pressuring [her] to leave the hotels, asking her where she is, telling her that she is late and asking her to get into the van [which takes her to the set immediately]. Usually [her] stress causes Hermes to start crying which then causes [her] to be frustrated toward him. I do not believe this is a healthy lifestyle for him."

The divorce action between Gossip Girl star Kelly Rutherford and her estranged husband has turned ugly, with the actress seeking to bar him from leaving the United States with their 2-year-old son for fear they'll disappear.
Estranged husband Daniel Giersch countered in L.A. Superior Court with papers alleging the actress, who's four months pregnant with their second child, has a bad temper, once throwing a laptop at him and another time trying to sock him with her fist.
Rutherford, 40, filed for divorce from Giersch, an entrepreneur, last month after being married a little over two years, seeking sole physical custody with monitored visitation. On the same day, Giersch filed for legal separation, seeking sole legal and physical custody with visitation for her.

The Gossip Girl writers have been given ample notice, but how will Kelly Rutherford prepare her own son Hermés, 2, for a new sibling?
"My husband [Daniel Giersch] actually found some really cute books about explaining to your kid about the baby that's coming and the mommy being pregnant and what goes on with the mommy and then what happens when you bring the baby home," the expectant Rutherford, 40, told PEOPLE Thursday at The Sylvania ShowHouse holiday lights event. "It's really helpful."
While her pregnancy has already had a big impact on her daily life, Rutherford doesn't see it impacting the fate of her character on GG, Lily Bass.
"I told [the writers] pretty much as soon as I found out, so they had some time to think about it," she says. "But they have so many great storylines going right now. I think they decided to go with [them]. I'll only be I think about six months pregnant when we go on hiatus so it shouldn't be too difficult to figure out and work around it."

Gossip Girl's Kelly Rutherford isn't afraid to admit she's had a little Botox – and she doesn't think other celebs should be shy about it, either.
During the Saks Fifth Avenue Key to the Cure Charity Shopping event in New York Tuesday, the actress, 39, said she had Botox injected once before she got pregnant with her son, Hermés, who turns 2 on Saturday.
"I think it's beautiful that people are sharing," said Rutherford, noting that women should be honest about everything from childbirth to beauty secrets. "We sit around at lunch and ask each other [questions], so why not say we had postpartum, giving birth is hell but the children are amazing – and I get Botox."
