Michael Phelps told police that he drank a beer about an hour and 15 minutes before he was involved in an accident last week, but alcohol wasn't the reason for the incident, according to a police source.

On Thursday, Phelps was driving a Cadillac Escalade when it collided with a Honda Accord driven by a Maryland woman. The athlete showed no signs of alcohol impairment, and was not given a field sobriety test.

"No alcohol was involved. No drugs," a police source said. "It was just a car accident."

Michael Phelps walked away uninjured Thursday night in downtown Baltimore after being behind the wheel of a late-model Cadillac Escalade when it collided with a Honda Accord that a woman was driving, say reports.

Police told the Baltimore Sun that besides Phelps's SUV, the Accord and a parked vehicle were seriously damaged during the 9 p.m. incident.

The female driver was described as "shaken up" and reportedly taken to a local hospital as a precaution. Police are said to have quizzed Phelps on what occurred. Alcohol was not a factor, according to news reports.

For Michael Phelps, what started as a night of celebrating with a small group in South Carolina turned into what he called "an awful judgment."

An email later alerted Phelps to the fact that an infamous photograph of him holding a bong had started to surface, he tells Matt Lauer in a Today interview airing Friday.

"I had no idea really what to do," he says. "You know, I knew that I'd made a mistake and made a bad judgment."

Less than an hour after a South Carolina sheriff said he would not file drug charges against Michael Phelps, Olympic star – who was photographed last fall smoking a marijuana pipe – issued another mea culpa and pledged to "dive back into the pool."

"I'm glad this matter is put to rest. But there are also some important lessons that I've learned," Phelps, 23, said in a statement Monday.

"For me, it's all about recognizing that I used bad judgment and it's a mistake I won't make again. For young people especially – be careful about the decisions you make. One bad decision can really hurt you and the people you care about."

Richland County sheriff Leon Lott announced earlier Monday that a nearly two-week investigation had failed to produce enough evidence to prosecute anyone present at a November party at the University of South Carolina, where the photo was taken.

Smoking pot is not grrrrrrrreat.

"Michael's most recent behavior is not consistent with the image of Kellogg. His contract expires at the end of February and we have made a decision not to extend his contract."

His mother, his two sisters and his coach will help Michael Phelps decide whether he will compete in the 2012 Olympics in the wake of the publication of a tabloid photo showing him smoking a marijuana pipe, the champion swimmer informs his hometown paper.

"This is a decision of mine that I'm not going to make today and I'm not going to make tomorrow," Phelps, 23, told the Baltimore Sun on Wednesday, after his daily workout at the Meadowbrook Athletic Club.

"It's going to require a lot of time and energy and a lot of thinking for myself. But also talking to Bob [Bowman, Phelps's coach] and talking to my family and just deciding what I want to do."

Olympian Michael Phelps is getting back to work after a controversial photo was published last weekend of the swimmer apparently inhaling from a marijuana pipe.

The gold medalist, 23, was spotted at a Baltimore pool Tuesday apparently for a training session, according to reports.

The reappearance follows Phelps admitting to using "bad judgment" after the U.K.'s News of the World printed the picture. "I'm 23 years old and despite the successes I've had in the pool, I acted in a youthful and inappropriate way, not in a manner people have come to expect from me," Phelps said.

Michael Phelps may have admitted to "bad judgment" after a photo of him apparently inhaling from a marijuana pipe was published, but the sheriff in Columbia, S.C., where the incident took place last November, could have the final word.

In a statement issued Tuesday, Sheriff Leon Lott Jr. said an investigation is underway – and charges could be pending against the Olympic star, 23.

"If someone breaks the law in Richland County, we have an obligation as law enforcement to investigate and to bring charges," the statement said. "The Richland County Sheriff's Department is making an effort to determine if Mr. Phelps broke the law. If he did, he will be charged in the same manner as anyone else. The Sheriff has a responsibility to be fair, to enforce the law and to not turn a blind eye because someone is a celebrity."

He may be the most celebrated Olympian of all time, but the only gold Michael Phelps is vying for nowadays is the kind that comes wrapped around a candy bar.

The record-breaking swimmer, who's won 14 gold medals in his career, admitted to Stephen Colbert on Thursday's Colbert Report that he's been taking a break from his rigorous regimen – and is a long way from being the athlete who wowed in Beijing.

"I'm out of shape right now," a grinning Phelps, 23, told Colbert.
