The courts ultimately will decide how Noah Wyle will be punished for participating in a Medicaid protest in Washington, D.C., earlier this year.
But even if the law turns out not to be on his side, the actor still has the approval of one important judge: his 9-year-old son, Owen.
"I did talk to my son after I got released early the next morning," Wyle, 40, tells PEOPLE. "I called him before school, and I explained what happened and that I was okay."

In a brewing controversy, Noah Wyle and 73 other people are being ordered to appear in court in Washington, D.C., next Tuesday after their arrest at a Medicaid protest last month.
The former ER actor was seen in handcuffs on April 23 in the rotunda of the Cannon House Office Building, where he and members of the disability-advocacy group ADAPT were urging Congress not to cut Medicaid.
Such arrests are fairly routine for ADAPT members, who are usually allowed to be represented in court by an attorney. Forcing them to appear in person is controversial, as many members live a plane ride away and will struggle to afford another trip to D.C. on short notice, Disability Scoop reports.

Like any actor, Noah Wyle prepared for his moment in the spotlight.
The former E.R. star had warned his estranged wife and two children, ages 6 and 9, that he might run into trouble with the police at a Washington D.C. protest this week.
"I think they're really proud of the old man right now," Wyle, 40, told the Associated Press Monday while waiting to be processed after his arrest.
The actor, who now stars in TNT's Falling Skies, was among about 100 protestors taken away in handcuffs during a Capitol Hill protest by the group ADAPT to urge Congress not to cut Medicaid.

Former ER star Noah Wyle has been arrested.
The actor was pictured in handcuffs where he and more than 100 other people were arrested during a protest at Capitol Hill on Monday.
Wylie and members of the group ADAPT were urging Congress not to cut Medicaid. The protesters were handcuffed in the rotunda of the Cannon House Office Building, according to the Associated Press.
ADAPT maintains that cuts in Medicaid would force elderly people and those with disabilities out of their homes and into nursing homes to get services they require.
Wyle is best known for his role as John Carter on NBC's hit medical drama ER. And, it was just about a month ago that another former ER star was arrested in D.C.: George Clooney found himself in the back of a secret service van after a Sudan protest.

Noah Wyle and his wife, Tracy, have separated after 11 years of marriage, the actor's rep tells PEOPLE.
"Tracy Wyle and Noah Wyle, who separated in late October 2009, have confirmed they have entered into a mediation process," rep Eddie Michaels announced in a statement on the couple's behalf. "Neither has legally filed for divorce. Tracy and Noah live in separate residences; however their two children (Owen, 7, and Auden, 4) see both parents daily."
